Terms & Conditions
The rules that govern use of our website, public content, and pre-engagement interactions.
Effective: July 31, 2026 · Last updated: July 31, 2026
Acceptance and eligibility
These Terms & Conditions ("Terms") govern your access to and use of avm-analytics.com and its public content. By using the website, you agree to these Terms. If you do not agree, do not use the website.
You represent that you are at least 18 years old and legally capable of entering into these Terms. If you use the website for an organisation, you represent that you have authority to act for that organisation.
Website information and non-clinical scope
AVM provides marketing, analytics, automation, and business-growth information and services. Website content is general business information, not medical, legal, tax, accounting, or investment advice.
AVM does not provide occupational therapy, medical evaluation, diagnosis, treatment, telehealth, or other clinical services through this website or its marketing engagements. You remain responsible for clinical decisions, professional standards, patient communications, and compliance within your organisation.
Professional-services engagements
A call, enquiry, proposal, or website interaction does not create a client relationship. Paid services begin only under a mutually accepted proposal, order form, statement of work, master services agreement, or other written engagement document.
Signed engagement terms control the scope, deliverables, fees, timeline, client responsibilities, intellectual property, confidentiality, data handling, cancellation, and liability for that engagement. If a signed agreement conflicts with these website Terms, the signed agreement controls.
No guarantee of results
Marketing, patient-acquisition, operational, and financial outcomes vary. AVM does not guarantee rankings, leads, appointments, revenue, profit, return on advertising spend, regulatory outcomes, or any other specific result.
Case studies, founder results, forecasts, illustrations, testimonials, and examples describe particular circumstances and are not promises or representations of typical outcomes. Results depend on factors outside AVM’s control, including market conditions, competition, budget, pricing, clinical capacity, staffing, payer mix, response time, sales process, client approvals, and implementation.
Your responsibilities
- Provide accurate information and use the website only for lawful business purposes.
- Do not submit PHI, identifiable patient information, account credentials, payment-card data, or other sensitive information through public forms or Calendly.
- Do not interfere with the site, introduce malicious code, scrape or harvest information, attempt unauthorised access, impersonate others, or misuse content.
- Obtain necessary legal, regulatory, clinical, and advertising review for your own organisation, claims, campaigns, consents, and data practices.
Intellectual property
The website, branding, copy, graphics, videos, frameworks, downloads, software, and other public materials are owned by or licensed to AVM and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive right to access the website for its intended purpose.
You may not reproduce, resell, distribute, modify, create derivative works from, remove notices from, or commercially exploit our materials without prior written permission, except as permitted by law.
Third-party services and links
The website may use or link to third-party services, including scheduling, video, analytics, advertising, and social platforms. Those providers operate under their own terms and privacy practices. AVM is not responsible for third-party availability, content, security, or conduct.
Disclaimers
To the fullest extent permitted by law, the website and public content are provided "as is" and "as available." AVM disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted access, error-free content, or compatibility with every device or service.
Limitation of liability
To the fullest extent permitted by law, AVM and its owners, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the website or public content. For claims relating only to free website use, AVM’s aggregate liability will not exceed US$100. Liability for paid services is governed by the applicable signed agreement.
Indemnification
You agree to defend, indemnify, and hold harmless AVM and its owners, personnel, contractors, and affiliates from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful website use, breach of these Terms, submitted materials, or infringement of another person’s rights.
Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Unless a signed client agreement provides otherwise, disputes arising from these Terms or the website will be brought in the state or federal courts with jurisdiction in Maryland, and each party consents to that jurisdiction and venue.
Changes and severability
We may revise these Terms by posting an updated version with a new effective date. Continued website use after an update constitutes acceptance of the revised Terms. If any provision is held unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver.
